National Property Advisory Pty Ltd (ABN 52 159 828 038) trading as “National Property Advisory” (‘NPA’, ‘the Company’, ‘we’, ‘us’) is committed to protecting your privacy. We are bound by the Australian Privacy Principles (‘APPs’) in the Privacy Act 1988 (Cth) (‘the Act’), and we collect, hold, use and disclose personal information only in accordance with the Act and this Privacy Policy.

This Privacy Policy applies to personal information (including sensitive information as defined in the Act) collected by the Company, including via this website (‘Website’), by phone, by email, through our enquiry and booking forms, and in the course of providing our services.

Our related lending entity. National Property Advisory and Nexus Private Lending Services Pty Ltd (ABN 37 169 705 926), Australian Credit Licence 463839 (‘Nexus’), are related entities with common directors and shareholders. Credit services referred to on this Website are provided by Nexus, not by NPA. Where you ask us to assist with finance, we may disclose your personal information to Nexus so that it can provide those services to you. Nexus handles credit-related personal information under its own privacy policy and credit reporting obligations, available on request or at nexusprivate.com.au.

1. What personal information we collect

Personal information we collect and hold may include your name, contact details (email address, telephone numbers, home and billing address, postcode, country of residence), date of birth, occupation and employment details, areas of interest, payment details where you purchase a service, information you provide in surveys, testimonials, webinar registrations and complaints, technical information such as your IP address and device/browser information, and records of your dealings with us.

We only collect personal information that is reasonably necessary for our functions and activities, which include providing property advisory, buyer’s agency and property management services, referring you (with your knowledge) to Nexus for lending services, and marketing and improving our services.

How we collect it. We collect personal information directly from you wherever reasonable and practicable – for example when you call us, submit an enquiry or booking form, register for a webinar or masterclass, or engage our services. We may also collect personal information from third parties where permitted by law, including related entities (such as Nexus, where you have engaged both businesses), publicly available records, and service providers who assist us to operate the Website and analyse Website traffic.

We do not collect credit reports or credit eligibility information. If you proceed with a lending enquiry, that information is collected and handled by Nexus under the Act, Part IIIA of the Act and the Privacy (Credit Reporting) Code.

Anonymity. You may browse this Website without identifying yourself. Where lawful and practicable, you may deal with us anonymously or using a pseudonym, though this may limit the services we can provide.

Unsolicited information. If we receive personal information we did not solicit, we will protect it in the same way as solicited information, or destroy or de-identify it where lawful and reasonable to do so.

2. How we use and disclose personal information

We use and disclose your personal information for the primary purpose for which it was collected and for related secondary purposes you would reasonably expect, including to:

1. provide our services to you and manage our relationship with you;
2. refer you to Nexus, at your request, for lending and mortgage broking services;
3. provide you with information about our services, events and promotions (see Direct Marketing below);
4. obtain professional, financial, technical or administrative advice and services in connection with operating our business (for example external advisers, IT and hosting providers, booking and scheduling platforms, and marketing service providers);
5. investigate and address suspected breaches of our Website terms, this Privacy Policy or the law, and to address complaints;
6. research and improve our services;
7. facilitate a sale or potential sale of all or part of our business; and
8. comply with our legal obligations, court or tribunal orders, or requests from enforcement bodies as defined in the Act.

We may also use or disclose your personal information for other purposes with your consent.

Direct marketing. Where you have enquired about our services or otherwise consented, we may contact you by email, SMS, phone or other means with information about our services, events and promotions. You can opt out at any time by using the unsubscribe link in our emails or by contacting us using the details in section 11. On request, we will also tell you the source of your information and will not disclose it to other organisations for their direct marketing.

3. Overseas disclosure of personal information

Some of the service providers we use to operate our Website and business store or process personal information outside Australia. These include scheduling, analytics, advertising and marketing platforms, and it is likely that personal information will be disclosed to recipients located in the United States and may be disclosed to recipients in the European Economic Area, the United Kingdom and New Zealand.

Before disclosing personal information overseas, we take reasonable steps to ensure the overseas recipient handles it in a manner consistent with the APPs, or we will otherwise only disclose it where permitted by the Act – for example where the recipient is subject to substantially similar privacy obligations, where the disclosure is required or authorised by law, or with your consent.

4. Data quality

We take reasonable steps to ensure that the personal information we collect, hold, use and disclose is accurate, up to date, complete and relevant. The quality of our records also depends on the information you and others provide to us, so please let us know if your details change or you believe information we hold about you is inaccurate, and we will take reasonable steps to correct it (see section 8).

To the maximum extent permitted by law, we are not responsible for loss or damage arising from inaccurate, incomplete or out-of-date information that was provided to us by you or by third parties, where we have taken the steps reasonably required of us under the Act. Nothing in this Privacy Policy excludes, restricts or modifies any rights you have, or any obligations we have, under the Act or any other applicable law that cannot lawfully be excluded, restricted or modified.

5. Security and data breaches

We take reasonable steps to protect the personal information we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include maintaining secure hosting, encrypted (SSL) transmission on our Website, access controls limiting who within our business can view personal information, and reputable third-party providers. We also take reasonable steps to destroy or permanently de-identify personal information that is no longer needed for any permitted purpose.

No method of electronic transmission or storage is completely secure. To the maximum extent permitted by law, we are not liable for loss or damage arising from unauthorised access to, or misuse of, your personal information by third parties, except to the extent that the loss or damage results from our failure to take the steps reasonably required of us under the Act. Nothing in this section limits your rights, or our obligations, under the Act, including your right to make a complaint (see section 11).

Notifiable data breaches. We are subject to the Notifiable Data Breaches scheme under Part IIIC of the Act. If a data breach occurs that is likely to result in serious harm to individuals whose personal information is involved, we will notify the affected individuals and the Office of the Australian Information Commissioner (‘OAIC’) as required by the Act. If you become aware of any suspected breach of security involving our Website or your personal information, please notify us immediately using the details in section 11.

6. Automated decision-making

We do not currently use computer programs to make, or to do things substantially and directly related to making, decisions that could reasonably be expected to significantly affect your rights or interests without human involvement. We use software tools for scheduling, analytics and marketing, but decisions about the services we provide to you are made by our people. If this changes, we will update this Privacy Policy to describe the kinds of personal information used and the kinds of decisions involved, as required by the Act.

7. Cookies and website analytics

We use cookies and similar technologies (small text or pixel files placed on your device) to operate the Website, remember your preferences, understand how visitors use the Website, and show you relevant content and promotions, including through third-party analytics and advertising platforms such as Google Analytics and Meta (Facebook) tools. These third parties may collect information about your visit under their own privacy policies.

You can manage or disable cookies through your browser settings, and you can opt out of personalised advertising through the settings offered by Google and Meta. If you continue to use the Website without changing your settings, we will treat this as your consent to our use of cookies as described here.

8. Access to and correction of your personal information

You may request access to, or correction of, the personal information we hold about you by contacting us using the details in section 11. We will respond within a reasonable time. We do not charge for making a request or for correcting information; if access involves significant retrieval or preparation work we may charge a reasonable administrative fee, and we will tell you of any charge before proceeding.

In limited circumstances the Act permits us to refuse access or correction. If we refuse your request, we will give you written reasons and information about how you may complain about the refusal.

9. Membership site and webinars

Any information, including personal information, that you choose to make public within our membership site, webinars or masterclasses will be visible to other participants in that area. Please take care with what you share. You consent to our collection and use of information you publish in those areas in accordance with this Privacy Policy and our Website terms of use.

10. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology or the law. The current version will always be published on this Website with its “last updated” date shown at the top. We encourage you to review it periodically. Your continued dealings with us after an update takes effect will be on the terms of the updated policy.

We take complaints seriously: we will acknowledge your complaint promptly, investigate it, and endeavour to respond with an outcome within 30 days.
